KOA Equipment Use & Responsibility Addendum This KO Bros Sports Academy Equipment Use and Responsibility Addendum (“Addendum”) is entered into between KOA (KO Bros SportsAcademy) and the undersigned parent/guardian and student-athlete (“Borrower”), and is incorporated into and made part of the general enrollment agreement and participation terms governing Borrower’s involvement with KOA programs. Purpose The purpose of this Addendum is to establish the responsibilities of Borrower regarding the use, care, and return of KOA-issued equipment, including but not limited to laptops and chargers, in compliance with the policies of KOA and applicable law, including the laws of the State of California and the Superior Court of San Mateo, County of San Mateo. Issuance of Equipment KOA agrees to loan Borrower the following equipment for academic and athletic program purposes: * One (1) KOA-issued laptop * One (1) KOA-issued charger Borrower Responsibilities By signing this Addendum, Borrower (parent/guardian and student-athlete jointly) acknowledges and agrees to the following: 1. Condition and Use * Borrower accepts the equipment in good working condition and agrees to use it solely for educational and program-related purposes. * Borrower shall exercise reasonable care in the handling, storage, and use of the equipment. 2. Return of Equipment * Borrower shall return the equipment to KOA in the same condition as issued, reasonable wear and tear excepted, immediately upon the conclusion of program participation or at KOA’s request. 3. Loss, Damage, or Theft * Borrower shall be financially responsible for any loss of, damage to, or theft of the equipment while in Borrower’s possession. * In the event of loss, damage, or theft, Borrower agrees to reimburse KOA the replacement or repair cost, up to a maximum of two hundred fifty dollars ($350.00). 4. Liability * Parent/guardian and student-athlete jointly and severally accept full liability for the equipment while in Borrower’s possession. * This liability obligation shall survive termination of participation in KOA programs until all equipment has been returned in acceptable condition or reimbursement has been made. 5. Acknowledgment of Legal Compliance * Borrower understands and agrees that this Addendum is enforceable under the laws of the State of California and subject to the jurisdiction of the Superior Court of San Mateo, County of San Mateo.
