KOA Shuttle Services Liability Waiver and Release This Liability Waiver and Release (“Agreement”) is entered into between KO Bros LLC, KO Bros Sports Academy (“KOA”), its directors, officers, employees, volunteers, agents, representatives, affiliates, partners, and any associated entities (collectively “Released Parties”), and the undersigned parent/guardian of the student-athlete identified below (“Participant”). By signing this Agreement, the undersigned acknowledges and agrees as follows: 1. Assumption of Risk I, the undersigned, understand and acknowledge that participation in the KOA Shuttle Services involves inherent risks, including but not limited to risks associated with travel in passenger vans, traffic accidents, sudden stops, injuries during entry or exit, unforeseen acts of third parties, and other transportation-related hazards. I voluntarily assume all such risks, known and unknown, associated with my child’s participation in the KOA Shuttle Services. 2. Release and Waiver of Liability To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless the Released Parties from any and all claims, demands, damages, actions, or causes of action of any kind, whether at law or in equity, arising out of or related to my child’s participation in KOA Shuttle Services, including but not limited to personal injury, illness, death, property damage, or other loss. This waiver and release expressly applies to any negligence (whether passive or active) of the Released Parties but does not extend to gross negligence, recklessness, or willful misconduct. 3. Medical Authorization In the event of an emergency, I authorize KOA staff, drivers, and/or volunteers to obtain medical treatment for my child as deemed necessary. I agree to be fully responsible for all costs of such medical treatment. 4. Parental/Guardian Responsibilities I understand that it is my responsibility to: Ensure my child arrives on time at the designated pick-up location. Ensure my child complies with all shuttle rules and driver instructions. Provide accurate emergency contact and medical information. 5. Indemnification I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising out of or related to my child’s participation in KOA Shuttle Services. 6. Governing Law and Venue This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any dispute arising under this Agreement shall be brought exclusively in the Superior Court of California, County of San Mateo. 7. Severability If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. 8. Acknowledgment of Understanding By signing below, I certify that I have carefully read this Agreement, fully understand its terms, and voluntarily agree to its provisions. I further acknowledge that I am waiving substantial legal rights on behalf of myself, my child, and my heirs, successors, and assigns.
